Terms of Service

1. Acceptance

By downloading, installing, or using the FishON! Pro mobile app or the FishON! Guide Portal (together, “the Services”), you agree to these Terms of Service. The Services are developed and published by Moonshinerxwerks LLC.

2. Description

FishON! Pro is a fishing intelligence platform that aggregates real-time environmental data from public agencies (USGS, NOAA Tides, NWS, NWRFC, and NDBC) to help anglers decide where to fish, and lets you log your trips, catches, and the conditions you find. The FishON! Guide Portal is a companion web application for professional guides.

3. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal use — or, for Guide-tier subscribers, your professional guiding operations — on devices you own or control, subject to these terms and the applicable app store terms.

4. Your Content

You retain ownership of all content you create in the Services, including trip reports (with your catches and field conditions), photos, and location data. You grant us a limited license to store and process your content solely to provide the Services. If you use the Guide Portal's public share links, you direct us to publish the selected content publicly; you are responsible for the content you choose to share and for having the right to share it.

5. Data Sync & Storage

• On iPhone and iPad, the app uses Apple's CloudKit to sync your data across your own Apple devices, within your personal iCloud account.
• On paid tiers and in the Guide Portal, your data is also stored in our secured cloud database (Firebase) so it is available across devices and on the web. Free Scout-tier app data is not stored in our cloud.
• You can disable iCloud sync or delete your data at any time, as described in our Privacy Policy.

6. Subscriptions, Purchases & Billing

FishON! offers a free Scout tier and two paid tiers, Angler and Guide:

6.1 Mobile app (Apple App Store / Google Play)

• Purchases in the app are processed by the Apple App Store (iOS) or Google Play (Android) and charged to that store account at confirmation.
• Annual subscriptions auto-renew at the then-current price unless cancelled at least 24 hours before the end of the current period. Manage or cancel anytime in your App Store or Google Play subscription settings; cancellation takes effect at the end of the current period.
• Lifetime purchases are one-time, non-recurring, and can be restored on a new device using the same store account.
• Entitlements are tied to the store account used and are not transferable between the Apple and Google ecosystems — a purchase on one platform does not unlock the other.

6.2 Guide Portal (Stripe)

• Access to the FishON! Guide Portal requires an active Guide subscription (Annual or Lifetime).
• Guide Portal subscriptions are billed directly through Stripe, not through an app store. Options are Guide Annual ($24.99/year), an auto-renewing subscription, and Guide Lifetime ($74.99), a one-time purchase.
• Manage your payment method, view invoices, or cancel an annual subscription through the Stripe billing portal linked in your account settings. Cancellation takes effect at the end of the current period.

6.3 Refunds

No refunds are provided for the unused portion of a subscription term once started, and lifetime purchases are non-refundable, except where required by law or by the applicable store's or processor's policies. App store purchases are refunded by Apple or Google under their policies; Stripe purchases are handled by us. 7. Prohibited Use

You may not reverse engineer, decompile, or disassemble the Services; use them for any unlawful purpose; attempt to gain unauthorized access to any systems connected to the Services; or use automated means to access the Services.

8. Disclaimer

The Services are provided “as is” and “as available.” We make no guarantees about the accuracy, reliability, or availability of environmental data sourced from public agencies, which may be delayed, incomplete, or inaccurate. Do not rely on the Services as your sole source for safety-critical decisions on the water. We are not responsible for decisions made based on information provided by the Services, including fishing location choices, safety decisions, or navigation.

9. Limitation of Liability

To the fullest extent permitted by law, Moonshinerxwerks LLC's total liability arising out of or related to your use of the Services will not exceed the amount you paid us in the twelve months preceding the claim, and we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Services, including damages arising from inaccurate environmental data, navigation errors, equipment damage, personal injury, or fishing outcomes.

10. Termination

We may suspend or terminate your access to the Services at any time for violation of these terms. Upon termination, your right to use the Services ceases immediately. Active subscriptions must be cancelled separately through your app store settings or the Stripe billing portal, as applicable.

11. Governing Law

These terms are governed by the laws of the State of Oregon, without regard to its conflict-of-laws rules.

12. Changes

We may modify these terms at any time. If we make material changes, we will notify you through the Services. Continued use after changes constitutes acceptance.
